The Trump Administration Requests Supreme Court Permission for State Guard Troop Deployment in Illinois
On Friday, the government filed an emergency request to the federal top court, asking for authorization to deploy national guard troops to Chicago and surrounding areas.
This move is part of a larger effort to increase the homefront role of the troops in a number of urban centers under Democratic control.
Legal Battle Over Troop Deployment
In an emergency filing, the justice department urged the judiciary to reverse a lower court ruling that had blocked the sending of several hundred national guard troops to the Chicago region.
The federal judge had raised doubts about the government's justification for activating the guard, challenging its explanation in light of regional circumstances.
A federal appeals court affirmed the lower court’s decision on the previous day, keeping the activation on standby while the judicial dispute continues.
Government's Justifications
The solicitor general, acting for the government, wrote in the new filing that federal agents have often been “threatened and attacked” in Chicago and the neighboring town of Broadview area.
This area is home to an Immigration and Customs Enforcement detention facility.
The commander-in-chief has earlier deployed national guard personnel to Chicago and Portland, Oregon, after earlier deployments to Los Angeles, Memphis, and Washington, District of Columbia.
The White House has claimed that military intervention is necessary to reduce protests and strengthen deportation efforts.
Ideological Resistance
Opposition leaders have vehemently criticized the move, arguing that the administration's assertions are inflated and partisan in nature.
They allege the administration of misusing his authority to target political rivals.
The judiciary have also expressed doubt about the White House's description of events.
Local leaders state that rallies over immigration enforcement have been mostly limited and peaceful, contradicting the president’s description of “battlefield” situations.
Jurisdictional Framework
At the core of the dispute is the government's invocation of a national law authorizing the executive branch to take control of the state guard only in instances of uprising or when “unable with the standard military to execute the laws of the US”.
The White House insists that the troops are necessary to safeguard government buildings and personnel from demonstrators.
Current Developments
Earlier this month, the government federalized 300 troops of the Illinois national guard and ordered extra guard from Texas troops into the Illinois.
As state authorities condemned the move, the former president escalated his rhetoric, urging the detention of Chicago’s mayor and the Illinois governor, each a Democrat, alleging them of not managing to secure ICE personnel.
The state of Illinois and Chicago filed a combined lawsuit the White House to stop the deployment.
On October 9, district Judge April Perry, appointed by Joe Biden, handed down a immediate block blocking the order.
